Q. If you participate in a diversion program and your case is dismissed, they tell you your records will be expunged if you do not have any convictions within 12 months. Does this include traffic tickets in another state? I am trying to help a friend and can't seem to find the information anywhere. Will the records still be sealed, since the case was already dismissed, or does the traffic violation (in another state) serve as a violation of the agreement? Thanks! My friend lives in Colorado (I live in a different state), and got the tickets in California. The ticket is for no proof of insurance. And to all people: if you're going to be rude because you spend your life answering questions on yahoo; spare me and answer someone else's question!… [cont.]

A. Your question is somewhat unclear. If your friend is still on diversion, then the case is not yet dismissed. If the case was already dismissed, nothing that happens now should change that. Your friend needs to speak to an attorney who is familiar with his conditions of diversion. Driving without insurance in California is a traffic infraction, with a maximum $200 fine for a first offense. (Veh. Code section 16029.) But I cannot tell you whether your friend's diversion would be violated by such a conviction, since I do not know what the conditions of that diversion are.
