Answered by teeeck5 - Sat Sep 9 12:29:37 2006 Car accident question crimina/civil.? Q. I drove my car into a flooded parking lot by accident. A week later, My car locked acted funny and I crashed into another car resulting in the other party being injured. The DA has charged me with 2nd degree assault. Was it my fault that my car seized and malfunctioned? The DA doesn't believe my car messed up. They also said I was speeding from accident reconstruction. I understand I'm liable from a civil standpoint, but a criminal standpoint, i don't think so. I appreciate any opinions from attorneys before I hire one. I appreciate it. i'm 18, i never knew this, the gov. should give out handbook with laws =x Asked by John K - Fri Feb 8 09:38:32 2008 - - 2 Answers - 0 Comments A. If you had notice that the car was malfunctioning and chose to drive it anyway, I think the theory is you are responsible for all of the consequences that flow from your action. In civil law, it would be negligence. In criminal law, assault sounds a bit harsh. An attorney can probably get it knocked down but a lot depends on how serious the crash and injuries were. If the DA has decided to make an example out of you, you can only hope for the best. You really should talk to an attorney. Many will give you an initial consultation for free or low cost. For the criminal part, you definitely need an attorney. Good luck. Answered by CGordo - Fri Feb 8 10:04:34 2008 Post-injury pain associated with poor weather conditions?
Q. As a result of an injury I tend to have bouts of both skeletal and muscular pain which appear to be linked with the onset of of stormy weather. What would trigger this onset of pain? Would it be caused by a change (a drop in) in the barometric pressure or something else? (I am 14 months post-injury and surgical reconstruction from a serious motor vehicle accident. The majority of the pain is located throughout my legs.) Many thanks! Asked by gonefornow - Thu Jul 3 22:43:59 2008 - - 2 Answers - 0 Comments A. As the barometric pressure changes, the fluid in the sacs at the joints is affected. You might experience pain with temperature changes also. Another trigger might be a change in altitude. I was injured several years ago and plane trips are absolutely the worst !!! I have a pain management program, and even the drugs cannot help if I fly. It only took one plane ride to learn this. LOL Remember, Darwin told us that survival goes to those most acceptable to change. I wish you well. Answered by Bandit - Thu Jul 3 23:08:58 2008 From Yahoo Answer Search: "Accident Reconstruction"
