How do the police decide if i was driving under the influence of marijuana?
Q. I was arrested for driving under the influence after being caught speeding. I failed a field sobriety test and they found two empty bags of marijuana (with nothign in it.) I didnt smoke that day, but i did the day prior and i submitted a urine test. Eventhough i wasnt driving under teh influence, when i go to court will they say i was?

Q. ever thought about those who drive under the influence of alcohol vs. the person who is extremely tired. in both situations the person who is very tired will have the same delay reaction to that who is under the influence. so why is the person who gets pulled over not in trouble if they are sleepy to that who is under the influence?

A. Both conditions involve an impaired driver. One is impaired by some impairing substance(s) and the other is impaired by fatigue...etc. The difference? One is illegal. The other is not. Driver's have civil liability for their actions regardless if it is criminal offense or not. If you're tired and kill someone, you're no less liable for that death than a drunk would be. The reason the sleepy person is not in trouble is that they have broken no law (just by being tired). The officer has done you a favor by giving you a little wake-up call. Good luck.

Q. Lets say you had 4-6 energy drinks and then drive, and you can't really focus on the road. Im guessing that their would be nothing the cop could do if you weren't drinking alchol. You would past the breath test, and even if they did a blood test it would only show caffeine, which their is no law that prohibits driving on a surger high.

I know i was wrong to do so, but the officer did not give me any leeway even though I passed the visual test but breathed .002 over the limit. (I had one beer, really.) So i'm thinking i need a good lawyer. Where is the best lawyer, attorney or whatever law firm I need to beat this bogus case? are there any recommended dui lawyers in Seattle or washington?

A. You're more likely to be granted entry into the US with a DUI record in Canada than the other way around, but it's really at the discretion of customs official. Any criminal record may be potential grounds to deny you.
